มาตรการทีมีประสิทธิภาพในการจัดระเบียบสังคมด้านบริการของกองบัญชาการตำรวจนครบาล

Abstract

          การศึกษาเรื่อง มาตรการที่มีประสิทธิภาพในการจัดระเบียบสังคมด้านสถานบริการของกองบัญชาการตำรวจนครบาล มีวัตถุประสงค์เพื่อศึกษามาตรการในการจัดระเบียบสังคม ด้านสถานบริการในเขตกรุงเทพมหานคร โดยใช้ระเบียบวิธีวิจัยผสมผสานระหว่างการวิจัยเชิงคุณภาพ (Qualitative Research) และการวิจัยเชิงปริมาณ (Quantitative Research) โดยการวิจัยเชิงคุณภาพใช้วิธีการสัมภาษณ์เพื่อเก็บข้อมูล และมีวัตถุประสงค์เพื่อศึกษาสาเหตุที่ทำให้การจัดระเบียบสังคมด้านสถานบริการไม่มีประสิทธิภาพ และนำมาเป็นกระบวนทัศน์หรือกรอบแนวคิดในการสร้างแบบสอบถามต่อไป ส่วนการวิจัยเชิงปริมาณใช้การสำรวจโดยแบบสอบถามเป็นเครื่องมือในการเก็บรวบรวมข้อมูล          ผลการศึกษาเชิงคุณภาพพบว่า สถานบริการเป็นสาเหตุสำคัญของปัญหาสังคมหลายประการ อาทิ ยาเสพติด การก่อความเดือดร้อนรำคาญ การมั่วสุมของกลุ่มวัยรุ่น ฯลฯ โดยเฉพาะสถานบริการประเภทหนึ่งและประเภทห้าที่มีขนาดใหญ่และไม่มีใบอนุญาต มาตรการในการจัดระเบียบสังคมด้านสถานบริการที่บังคับใช้ในปัจจุบันนั้น “ถือได้ว่าไม่ประสบความสำเร็จ” อันเนื่องจากมาตรการดังกล่าวยังมีข้อบกพร่องหลายประการ จึงได้นำเสนอมาตรการในการพัฒนาการจัดระเบียบสังคมให้มีประสิทธิภาพ ดังนี้ (1)การปราบปรามกลุ่มผู้มีอิทธิพลหรือกลุ่มผู้มีผลประโยชน์ที่มีส่วนได้ส่วนเสียจากสถานบริการอย่างจริงจัง (2) การประชาสัมพันธ์ สร้างความเข้าใจ และสร้างจิตสำนึกระหว่างเจ้าหน้าที่ตำรวจหรือสำนักงานตำรวจแห่งชาติกับสถานบริการ (3) ด้านแสวงหาความร่วมมือจากประชาชน (4) ด้านการแสวงหาความร่วมมือจากหน่วยงานที่เกี่ยวข้อง (5) ด้านกฎหมาย          ผลการศึกษาเชิงปริมาณพบว่า เจ้าหน้าที่ตำรวจที่มีหน้าที่ในการจัดระเบียบสังคมมีความเห็นว่า สถานบริการเป็นแหล่มั่วสุมทางเพศและยาเสพติดของกลุ่มวัยรุ่น และมักจะมีการละเมิดกฎหมายโดยการเปิดเกินเวลากว่าที่กฎหมายกำหนดไว้ นอกจากนี้ยังเห็นด้วยกับมาตรการในการจัดระเบียบสังคมข้างต้น          หลังจากนั้นได้นำผลการศึกษาเชิงคุณภาพ และเชิงปริมาณมาวิเคราะห์และได้นำเสนอข้อเสนอแนะเพื่อทำให้มาตรการในเรื่องนี้เป็นไปอย่างมีประสิทธิภาพ โดนเสนอแนะให้มีการแก้ไขกฎหมายที่เกี่ยวข้องกับสถานบริการเพื่อมุ่งเน้นให้ดำเนินคดีกับสถานบริการขนาดใหญ่ที่ปล่อยให้มีการกระทำผิดเกี่ยวกับยาเสพติด นำมาตรการทางภาษีและกฎหมายฟอกเงินมาใช้ดำเนินคดีกับผู้กระทำผิดสถานบริการ ตลอดจนดำเนินคดีกับเจ้าของสถานบริการที่แท้จริง นอกจากนี้ควรมีการส่งเสริมให้ภาคเอกชนเข้ามามรส่วนร่วมในการบังคับใช้กฎหมายสถานบริการ และเสริมสร้างจรรยาบรรณของผู้ประกอบธุรกิจสถานบริการ           The study of “Measures for Social Order to Control Entertainment Business in Bangkok” has the objective to find out the effective measure to control entertainment business in Bangkok. This research has employed both a qualitative and a quantitative approach. The qualitative research employed the interview method to collect data in order to understand the situation of Social Order in controlling this business and to create a conceptual framework of this study. The quantitative research applied a questionnaire to collect data to test the hypothesis.          The qualitative research found that the entertainment business, especially the entertainment business type (1) and (5), has create the serious social problem such as drug, prostitution, and nuisance behaviors. The social order has been considered ineffective to control this business. The study suggests the measure to improve the social order as follow: (1) enforcement of interest group (2) improvement of relationship with entrepreneur (3) participation with public (4) collaboration among public agencies and (5) improvement of law.          The quantitative research finds that some entertainment business is the place with drug problem and prostitution of Thai teenagers. This business always opens for the customers beyond the time permitted by law. Also, the samples agree with the measure suggested fond by the qualitative research.          Analysis of the results in the suggestion to improve the measures. These suggestions include the improvement of law to control the large entertainment business that allow drug using, to use financial measure against the violators and to suppress the interest groups. The enforcement should aim at the real owner of the entertainment should aim at the real owner of the entertainment business. Also, the measure should encourage the public and the entrepreneur o assist the police.
