การจำกัดสิทธิสมัครรับเลือกตั้ง กรณีสมาชิกสภาผู้แทนราษฎร สมาชิกสภาท้องถิ่น และผู้บริหารท้องถิ่น ลาออกก่อนครบวาระใช้สิทธิลาออกโดยไม่สุจริต

Abstract

          การศึกษาเรื่องการจำกัดสิทธิสมัครรับเลือกตั้ง กรณีสมาชิกสภาผู้แทนราษฎร สมาชิกสภาท้องถิ่น และผู้บริหารท้องถิ่น ใช้สิทธิลาออกโดยไม่สุจริต มีวัตถุประสงค์เพื่อ 1) หาสาเหตุและวิเคราะห์ผลกระทบจากการลาออกก่อนครบวาระของสมาชิกสภาผู้แทนราษฎร สมาชิกสภาท้องถิ่นและผู้บริหารท้องถิ่นที่มีเจตนาสมัครรับเลือกตั้งใหม่ในตำแหน่งเดิมโดยไม่สุจริต 2) วิเคราะห์ผลกระทบที่เกิดจากสาเหตุดังกล่าว ซึ่งทำให้เกิดความเสียหายต่อระบบการเลือกตั้งและงบประมาณของประเทศ 3) เพื่อหาทางป้องกันและเสนอแนะแนวทางแก้ไขปัญหาต่อไป           การวิจัยเป็นการวิจัยเชิงคุณภาพ โดยการวิจัยเอกสาร ด้วยการรวบรวมข้อมูลจากหนังสือตำรา ตัวบทกฎหมาย วิทยานิพนธ์ เอกสารประกอบการเรียนการสอน การสัมมนา รวมถึงข้อมูลสารสนเทศบนอินเตอร์เนต ทั้งภาษาไทยและภาษาอังกฤษ โดยนำปัญหาที่เกิดจากการลาออกของนักการเมืองที่ส่งผลกระทบต่อการเลือกตั้ง มาวิเคราะห์เปรียบเทียบสาเหตุและผลกระทบที่เกิดขึ้นเพื่อนำไปสู่ผลการวิจัย          ผลการวิจัยพบว่า การลาออกก่อนครบวาระสมาชิกสภาผู้แทนราษฎร สมาชิกสภาท้องถิ่น และผู้บริหารท้องถิ่นโดยมีเจตนาไม่สุจริต ลาออกเพื่อสมัครในตำแหน่งเดิม หรือลาออกเพื่อหวังผลทางการเมืองแก่ตนเองหรือพวกพ้อง หรือทำให้ผู้อื่นเสียเปรียบในการสมัครรับเลือกตั้งถือว่าเป็นการใช้สิทธิโดยไม่ชอบ ขัดหลักสุจริต ไม่เป็นไปตามหลักประชาธิปไตย และกระทบหลักสาธารณประโยชน์ ถึงแม้การลาออกเป็นสิทธิและเสรีภาพตามรัฐธรรมนูญของแต่ละบุคคลแต่การลาออกโดยมีเจตนาไม่สุจริตได้ส่งผลกระทบต่อระบบการเลือกตั้ง สิ้นเปลืองงบประมาณของรัฐ ดังนั้น กฎหมายก็ไม่จำเป็นต้องคุ้มครองสิทธิของบุคคลเหล่านั้น และควรมีวิธีการป้องกันปัญหาเหล่านั้นเพื่อลดความเสียหายต่อประโยชน์ของรัฐ และป้องกันนักการเมืองอาศัยช่องโหว่ของกฎหมายเพื่อความได้เปรียบทางการเมือง          ดังนั้นจึงเสนอแนวทางแก้ไขปัญหาดังกล่าว ดังนี้          1. ผู้สมัครรับเลือกตั้งลาออกจากตำแหน่งโดยมีเจตนาสุจริต มีเหตุจำเป็นที่จะต้องลาออก และไม่หวังผลทางการเมือง ผู้นั้นสามารถสมัครรับเลือกตั้งใหม่ในตำแหน่งที่ลาออกได้จะไม่ถูกจำกัดสิทธิสมัครรับเลือกตั้ง          2. การลาออกจากตำแหน่งโดยมีเจตนาไม่สุจริตหรือมีพฤติการณ์แวดล้อมไม่สุจริตและหวังผลทางการเมือง จะต้องถูกจำกัดสิทธิสมัครรับเลือกตั้ง โดยงานวิจัยนี้ได้เสนอให้แก้ไขเพิ่มเติมบทบัญญัติกฎหมายที่เกี่ยวข้องเกี่ยวกับการจำกัดสิทธิสมัครรับเลือกตั้ง ดังนี้ “ผู้ใดลาออกจากตำแหน่งก่อนครบวาระ หากมีพฤติการณ์หรือมีเหตุอันควรเชื่อได้ว่ามีเจตนาไม่สุจริตในการลาออก ผู้นั้นจะต้องถูกจำกัดสิทธิสมัครรับเลือกตั้งโดยห้ามมิให้สมัครรับเลือกตั้งใหม่ในตำแหน่งที่ลาออก”          The current study was conducted in order to: 1) find out causes of the resignation before completing the full term of members of the House of Representatives, local council members, and local administrators, who run for election in order to be elected as the same position with dishonest intention; 2) analyze the effects occurred from those causes which affect the election system and the country’s budget; and 3) give some solutions to solve the problem.          This research is a qualitative study. The data were collected from doing document research by gathering information from books, textbooks, legislations, theses, teaching supplementary materials, seminar, and information from the internet both in Thai and English versions. Causes and effects caused by the resignation affecting the election system were analyzed and compared.          The results of the study revealed that the resignation before completing the full term of members of the House of Representatives, local council members, and local administrators who have resigned with a dishonest intention to resign, an intention to apply for the same position and to take advantages for themselves or for their companions, or to make other people lose, is considered as a dishonest act. It is not accordance with democratic primary, and it affects public benefits. Although the resignation is everyone’s right and freedom, the resignation with dishonestly used rights affect the election system and the waste of the country’s budget. Therefore, those people should not be protected by the laws. In addition, there should be methods to prevent those problems in order todecrease the damage to the interests of the state and to prevent those politicians who try to take advantages by using the weaknesses of the laws.          Therefore, the solutions to solve the problems are offered as the following.          1. Candidate who has resigned from the position from the position with an honest intention, proper reasons, and without an intention to take advantages from the politics can apply to be a candidate for that position.          2. Candidate who has resigned from the position with a dishonest intention, improper reasons, and an intention to take advantages from the politics must be suspended the right of such person to apply to be a candidate for an election. The study offers as “Candidate, who has resigned before completing the full term if there is an evidence to reasonably believe that such person resigned from that position with a dishone stintention must be suspended the right to apply to be a candidate for that position.” By revising the Act about the suspension of the right to apply to be a candidate for an election.
