ปัญหาการมีส่วนร่วมของประชาชนในการบังคับใช้พระราชบัญญัติรักษาความสะอาดและความเป็นระเบียบเรียบร้อยของบ้านเมือง พ.ศ. 2535

Abstract

          ประเทศไทยมีกฎหมายเกี่ยวกับสิ่งแวดล้อมอยู่มากมายหลายฉบับ รวมทั้งพระราชบัญญัติรักษาความสะอาดและความเป็นระเบียบเรียบร้อยของบ้านเมือง พ.ศ. 2535 ซึ่งเป็นกฎหมายเกี่ยวกับสิ่งแวดล้อมที่มีความเกี่ยวข้องกับการดำรงชีวิตประจำวันของประชาชนแต่ประชาชนมิได้ให้ความสำคัญ จึงทำให้การบังคับใช้กฎหมายฉบับนี้ ไม่มีประสิทธิภาพ          จากการศึกษาพบว่า พระราชบัญญัติรักษาความสะอาดและความเป็นระเบียบเรียบร้อยของบ้านเมือง พ.ศ. 2535 มีบทบัญญัติที่มีความเกี่ยวข้องกับการดำรงชีวิตประจำวันของประชาชนมากจนเกินไป จึงทำให้ไม่มีการบังคับใช้กันอย่างจริงจังเท่าที่ควร          สาเหตุสำคัญอีกประการหนึ่งที่ส่งผลให้พระราชบัญญัติฉบับดังกล่าวไม่ได้รับความสนใจในการบังคับใช้กฎหมายก็คือ พระราชบัญญัตินี้มีบทลงโทษเพียงโทษปรับเล็กน้อย ซึ่งทำให้ประชาชนไม่มีความเกรงกลัวที่จะฝ่าฝืนบทบัญญัติของพระราชบัญญัติฉบับนี้สำหรับในส่วนภาครัฐ จากการศึกษาพบว่า เจ้าหน้าที่ผู้มีอำนาจบังคับใช้พระราชบัญญัติฉบับดังกล่าวมักยังเพิกเฉยต่อการใช้อำนาจที่มี ซึ่งส่งผลให้เป็นการสนับสนุนให้ประชาชนกระทำความผิดตามพระราชบัญญัติฉบับนี้          ในการแก้ปัญหาควรปลูกฝังเรื่องการให้ความสำคัญเรื่องของสิ่งแวดล้อมให้แก่ประชาชนทราบว่าสิ่งแวดล้อมมีความสำคัญต่อการดำรงชีวิตเพียงใดและเผยแพร่ให้ประชาชนรู้ว่ามีบทบัญญัติกำหนดการกระทำที่เป็นความผิดตามพระราชบัญญัติฉบับนี้ และมีมาตรการจูงใจต่างๆ รวมทั้งโทษ เพื่อส่งเสริมให้ประชาชนปฏิบัติตามพระราชบัญญัติฉบับนี้ควรมีการเพิ่มเติมโทษปรับให้มากขึ้น เพื่อกระตุ้นให้ประชาชนมีความเกรงกลัวและปฏิบัติตามกฎหมายมากขึ้นในส่วนของภาครัฐ ควรมีการเพิ่มรางวัลนำจับให้แก่เจ้าหน้าที่ผู้ปฏิบัติหน้าที่ด้วย          Thailand has many laws on environmental issues including the Act on maintenance of cleanliness and public order B.E. 2535. It is a law on the environment which is relevant to the daily lives of people. But the people did not pay attention. As a result, enforcement of this law is not as effective as it should.          From study found that the Act on maintenance of cleanliness and public order B.E.2535 has provisions relevant to the daily lives of the people too much. It has no enforcement seriously as they should.          Another important reason that caused such Act did not receive the attention of law enforcement is that this law is punishable by a fine against offenders only slightly. This makes people not afraid to violate the provisions of this Act.          For the public sector, from study found that government officials authorized to enforce the law in this Act are inaction to use of existing authority. This results in support for people offense under the Act.          The solution should instill the importance of environmental issues to the public that the environment is important to the livelihood and release to the public to know that there is a provision that defines the offense action under the Act. And have incentive measures, including penalty for it. To encourage people to comply with the Act, should be added to be more fines, to encourage citizens to fear and obey the law more. In terms of public sector, should be added the arresting award to the authorities who officiate.
