กฎต้นแบบเพื่อการบริหารจัดการอสังหาริมทรัพย์ของมหาวิทยาลัยในกำกับของรัฐ ตามหลักนิติธรรมและธรรมาภิบาล

Abstract

          บทความวิจัยนี้มีวัตถุประสงค์ในการจัดทำกฎต้นแบบเพื่อการบริหารจัดการอสังหาริมทรัพย์ของมหาวิทยาลัยในกำกับของรัฐให้มีความชอบด้วยหลักนิติธรรมและธรรมาภิบาล โดยใช้วิธีวิทยาการวิจัยเชิงคุณภาพ ด้วยการวิจัยเอกสาร การสัมภาษณ์เชิงลึก การระดมความคิดเห็นโดยการสนทนากลุ่มเจาะจงและการรับฟังความคิดเห็น ผลการวิจัยพบว่า หลักนิติธรรมมี 6 องค์ประกอบ หลักธรรมาภิบาลมี 10 ข้อ และมหาวิทยาลัยที่ศึกษา 5 แห่ง คือ มหาวิทยาลัยเทคโนโลยีสุรนารี มหาวิทยาลัยมหามกุฏราชวิทยาลัย มหาวิทยาลัยเทคโนโลยีพระจอมเกล้าธนบุรี มหาวิทยาลัยมหิดล และจุฬาลงกรณ์มหาวิทยาลัย อสังหาริมทรัพย์ของมหาวิทยาลัยมี 2 ประเภท คือ ประเภทที่มหาวิทยาลัยมีกรรมสิทธิ์ และประเภทที่มหาวิทยาลัยมีสิทธิครอบครอง การออกกฎในการบริหารจัดการอสังหาริมทรัพย์ เป็นอำนาจของสภามหาวิทยาลัย สามารถกระทำได้ 2 ทาง คือ สภามหาวิทยาลัยมอบอำนาจการบริหารจัดการกับสภามหาวิทยาลัยบริหารจัดการเอง การวิจัยพบว่า เมื่อนำหลักนิติธรรมและธรรมาภิบาลมาวิเคราะห์กับกฎหมายที่เกี่ยวข้องกับการบริหารจัดการอสังหาริมทรัพย์ของมหาวิทยาลัยที่ศึกษาพบว่า บางมหาวิทยาลัยมีกฎการบริหารจัดการอสังหาริมทรัพย์แต่สาระสำคัญในกฎไม่อาจชี้ชัดได้ว่ามีการนำองค์ประกอบหลักนิติธรรมและธรรมาภิบาลมาใช้ บางมหาวิทยาลัยไม่มีกฎเป็นการใช้อำนาจดุลพินิจของสภามหาวิทยาลัย จึงไม่อาจตรวจสอบได้ว่าทุกครั้งที่สภามหาวิทยาลัยพิจารณาวินิจฉัยการบริหารจัดการอสังหาริมทรัพย์ได้นำหลักนิติธรรมและหลักธรรมาภิบาลมาใช้ประกอบการพิจารณาทุกครั้ง อย่างครบถ้วนเพียงใด ดังนั้น กฎต้นแบบที่จัดทำเพื่อเป็นต้นแบบสำหรับการจัดทำกฎว่าด้วย การบริหารจัดการอสังหาริมทรัพย์ของมหาวิทยาลัยในกำกับของรัฐตามหลักนิติธรรมและธรรมาภิบาล มี 2 รูปแบบ คือ กฎต้นแบบที่สภามหาวิทยาลัยมอบอำนาจกับกฎต้นแบบที่สภามหาวิทยาลัยบริหารจัดการเอง การวิจัยมีข้อเสนอแนะ 3 ด้าน คือ (1) ด้านกฎหมาย ด้วยการให้สภามหาวิทยาลัย สร้างกฎการบริหารจัดการอสังหาริมทรัพย์ ตามหลักนิติธรรมและธรรมาภิบาล โดยมีแนวทางจากกฎต้นแบบเพื่อให้การบริหารจัดการอสังหาริมทรัพย์ของมหาวิทยาลัยในกำกับของรัฐเป็นไปตามหลักนิติธรรมและธรรมาภิบาล (2) ด้านนโยบาย ด้วยการกำหนดให้มีการบริหารจัดการอสังหาริมทรัพย์ ต้องเป็นไปตามหลักนิติธรรม และธรรมาภิบาล (3) ด้านการบริหารจัดการ เสนอแนะให้มีการแยกรายได้จากการบริหารจัดการอสังหาริมทรัพย์ ออกจากเงินรายได้ประเภทอื่นและกำหนดหลักเกณฑ์การจัดสรรให้สอดคล้องตามพันธกิจ หลักการ และวัตถุประสงค์การจัดตั้งมหาวิทยาลัยตามกฎหมายจัดตั้ง          The purpose of this research is to set up a regulation model of property management as to the principles of Rule of Laws and Good Governance. The research methodology was qualitative research including documentary research, in-depth inview, focus group, and hearing.          The research results showed that there were 6 components of the Rule of Law, and 10 items of Good Governance. There are 5 selected autonomous universities for cases study -- Suranaree University of Technology, Mahamakut Buddhist University, King Mongkut's University of Technology Thonburi, Mahidol University, and Chulalongkorn University. The research found that there were two types of university properties including university owned property and the university ownership property. The University Council has legal authority to issue regulation for the management of these properties in two ways -- the University Council assigned to university administrative committee to issue regulation for the management of the properties and issue the regulation to authorize itself for management of the properties. The research found that when analyzing the application of the properties management under the laws concerned, there are some universities having the Property Management Regulations which follow the Principles of Rule of law and Good Governance, but the main elements of the regulation could not be clearly analyze whether the management had applied the principles of Rule of Law and Good Governance or not. Some universities had no Management Regulation, the University Council managed the properties by its own judgement. Therefore, it could not be confirmed that every time the University Council would apply the Rule of Law and Good Governance in making a decision on property management completely. Thus, the Regulation Model was designed to be the prototype of property management to ensure that the management will follow the Principles of Rule of Law and the Good Governance.          The research recommended 3 aspects, i.e., (1) Legal aspect: University Council issues Property Management Regulation according to the principles of Rule of Law and Good Governance guided by the Regulation Model to ensure that property management of the autonomous university is properly governed according to the principles of Rule of Law and Good Governance. (2) Policy aspect: property management must be in accordance with the Rule of Law and Good Governance. (3) Management aspect: the income from properties should be separated from other incomes, and the management regulation should be in accordance with missions, principles, and the university’s objectives according to the University Establishment Law.
