Guidance for the Development of Administrative Dispute Mediation before Court Proceedings: A Comparative Study of Administrative Dispute Mediation in Thailand and the United States of America

Abstract

ด้วยเหตุที่ประเทศไทยยังไม่มีแนวทางหรือกฎหมายที่ชัดเจนที่จะนำมาปรับใช้กับการไกล่เกลี่ยข้อพิพาททางปกครองก่อนการฟ้องคดีส่งผลให้การระงับข้อพิพาททางปกครองต้องกระทำผ่านกระบวนพิจารณาของศาลปกครองซึ่งมีขั้นตอนที่เคร่งครัด กินระยะเวลายาวนาน และคำพิพากษาของศาลอาจส่งผลให้คู่กรณีบาดหมางกันมากขึ้น บทความนี้จึงมีวัตถุประสงค์เพื่อศึกษาเปรียบเทียบแนวทางและกฎหมายที่เกี่ยวข้องกับการไกล่เกลี่ยข้อพิพาททางปกครองก่อนที่จะมีการฟ้องคดีต่อศาลปกครองระหว่างประเทศไทยและสหรัฐอเมริกา โดยผู้ศึกษาพบว่าสหรัฐอเมริกามีกฎหมายเฉพาะเกี่ยวกับการไกล่เกลี่ยข้อพิพาทในคดีปกครองก่อนการฟ้องคดี ได้แก่ รัฐบัญญัติว่าด้วยการระงับข้อพิพาททางปกครอง ค.ศ. 1996 มีการจัดตั้งหน่วยงานที่มีความเชี่ยวชาญและมีหน้าที่ในการไกล่เกลี่ยคดีปกครองโดยเฉพาะ และมีการกำหนดผลของการระงับข้อพิพาททางปกครองโดยวิธีการไกล่เกลี่ยไว้อย่างชัดเจน ผู้ศึกษาจึงได้เสนอว่าประเทศไทยควรออกกฎหมายที่เกี่ยวกับการไกล่เกลี่ยข้อพิพาททางปกครอง มีการจัดตั้งองค์กรที่มีความชำนาญในการ ไกล่เกลี่ยคดีปกครอง และมีการกำหนดวิธีการบังคับให้เป็นไปตามผลของการไกล่เกลี่ยคดีปกครองไว้โดยชัดแจ้ง เพื่อให้ข้อพิพาทในทางปกครองระงับลงได้อย่างมีประสิทธิภาพ รวดเร็ว และเป็นมาตรฐานเดียวกัน  Thailand has neither a clear guidance nor a regulation concerning administrative dispute mediation before court proceedings. Respectively, administrative disputes must be submitted to the Administrative Court which has strict procedures, takes a long time and the judgement or the order of the Court may result in the deeper resentment of the parties. This article, therefore, will conduct a comparative study of Administrative Dispute Mediation in Thailand and the United States of America. We found that the United States of America has a regulation regarding administrative dispute mediation called ‘Administrative Dispute Resolution Act of 1996’. Additionally, it stablishes special organizations which is skilled in administrative dispute mediation and specify the enforcement of the mediation verdict. We, therefore, suggest that, firstly, Thailand should issue a specific law regarding administrative dispute mediation. Secondly, it should establish a skilled organization for administrative dispute mediation. Lastly, the enforcement of the mediation should be clearly specified so as to effectively settle the administrative disputes.
