ปัญหาและอุปสรรคการบังคับใช้กฎหมายตามพระราชบัญญัติเพิ่มอำนาจตำรวจในการป้องกันและ ปราบปรามการกระทำผิดทางน้ำ พ.ศ. 2496

Abstract

          วิทยานิพนธ์ฉบับนี้มีวัตถุประสงค์เพื่อศึกษา ความเป็นมาและความสำคัญของปัญหาเกี่ยวกับการบังคับใช้กฎหมายตามพระราชบัญญัติเพิ่มอำนาจตำรวจในการป้องกันและปราบปรามการกระทำผิดทางน้ำ พ.ศ. 2496 โดยทำการศึกษาบทบัญญัติและมาตรการบังคับใช้กฎหมายตามพระราชบัญญัติฉบับดังกล่าว และนำมาวิเคราะห์ พร้อมเสนอแนะปรับปรุงเพื่อให้เจ้าพนักงานตำรวจน้ำสามารถปฏิบัติหน้าที่ได้อย่างมีประสิทธิภาพสูงสุด          ผลจากการศึกษาพระราชบัญญัติเพิ่มอำนาจตำรวจในการป้องกันและปราบปรามการกระทำผิดทางน้ำ พ.ศ. 2496 พบว่า คำนิยามว่า ยานพาหนะ ยังคลุมเครือไม่ชัดเจน ทำให้เกิดปัญหาและอุปสรรคจนไม่สามารถบังคับใช้กฎหมายได้อย่างมีประสิทธิภาพ อีกทั้งการให้อาณัติสัญญาณว่ายานพาหนะอยู่ในความควบคุมของเจ้าพนักงานตำรวจน้ำ และเรื่องการสั่งควบคุม สั่งหยุดพาหนะ ซึ่งมิได้กำหนดวิธีการสั่งห้าม สั่งควบคุม ยานพาหนะที่มีขนาดเล็ก แล่นระหว่างแม่น้ำ ลำคลอง และน้ำจืด จึงไม่มีแนวทางปฏิบัติที่แน่นอน ด้านบทกำหนดโทษค่าปรับและวิธีดำเนินการกระบวนการตามกฎหมายของพระราชบัญญัติดังกล่าว ที่มีการใช้มาแล้วประมาณ 64 ปี เห็นควรมีการปรับปรุงและเพิ่มอัตราโทษให้สูงขึ้น เพื่อให้การบังคับใช้กฎหมายมีประสิทธิภาพมากขึ้น          ข้อเสนอแนะการศึกษาเห็นควรปรับปรุงแก้ไขคำนิยามตามมาตรา 3 พระราชบัญญัติเพิ่มอำนาจตำรวจในการป้องกันและปราบปรามการกระทำผิดทางน้ำ พ.ศ. 2496 คำว่า ยานพาหนะ คือ เรือซึ่งใช้เดินทางระหว่างภายในราชอาณาจักรหรือระหว่างราชอาณาจักรกับดินแดนต่างประเทศไม่ว่าจะใช้เพื่อบรรทุก ลำเลียง โดยสาร ลาก จูง ดัน ยก ขุดหรือลอก รวมถึงสิ่งที่เคลื่อนที่ได้ในน้ำและสามารถใช้ในน้ำได้ทำนองเดียวกัน และแก้ไขมาตรา 5 รวมถึงมาตรา 6 การสั่งห้าม สั่งหยุดยานพาหนะ คือ แสดงสัญญาณเสียงพร้อมไฟฉุกเฉิน สำหรับยานพาหนะที่มีขนาดเล็ก และเพิ่มเติมบทกำหนดโทษให้มีอัตราโทษที่สูงขึ้นตามมาตรา 7 โดยกำหนดโทษจำคุกไม่เกินสิบปีหรือปรับไม่เกินสองแสนบาท หรือทั้งจำทั้งปรับ และกำหนดให้เจ้าพนักงานตำรวจน้ำเป็นพนักงานสอบสวนตามความผิดในพระราชบัญญัติดังกล่าว เพื่อให้สามารถใช้ในการป้องปรามอาชญากรที่ต้องการกระทำความผิด ส่งผลให้การบังคับใช้กฎหมายมีประสิทธิภาพมากขึ้น           This thesis aims to study the background and significance of law enforcement problems, in accordance with the Police Enforcement Act for the prevention and suppression of water crimes, 1953 by studying the provisions and enforcement measures under the Act as mentioned above, analyze, recommend, improve in order to the marine police officer can perform the duties with maximum efficiency.          The result of the study of the Police Enforcement Act for the prevention and suppression of water crimes, 1953 found that the definition of "vehicle" was unclear, and causing problems and barriers to enforce the law effectively.
