อนาคตท้องถิ่นไทยที่มิใช่รัฐส่วนกลาง : สิ่งที่ขาดหายไปจากการกระจายอำนาจองค์กรปกครองส่วนท้องถิ่น

Abstract

          บทความวิชาการนี้มุ่งศึกษาและทำการสำรวจในขอบข่ายเนื้อหาทางด้านการปกครองส่วนท้องถิ่นในส่วนที่เกี่ยวข้องกับอำนาจและโครงสร้าง บทบาทหน้าที่ตามที่ท้องถิ่นมีอำนาจ ทั้งจากตัวบทในรัฐธรรมนูญที่เกี่ยวข้องจากอดีตที่ผ่านมาและหนังสือ บทความ ตำรา เอกสาร และผลงานวิจัยที่มีเนื้อหาครอบคลุมที่เกี่ยวข้องกับการกระจายอำนาจการปกครองท้องถิ่นไทย ที่ผู้เขียนพยายามสะท้อนปัญหาการกระจายอำนาจจากราชการส่วนกลางหรือจากผู้กำหนดนโยบายจากระดับชาตินำมาสู่การกระจายอำนาจทางการปกครองส่วนท้องถิ่นที่ยังหวงอำนาจไว้กับส่วนกลาง พยายามจะสร้างรูปแบบการปกครองส่วนท้องถิ่นให้เปรียบเสมือนการย่อส่วน การปกครองราชการส่วนกลางหรือระดับชาติมาใช้ในการปกครองกับส่วนท้องถิ่นให้คนในชุมชนหรือคนในท้องถิ่นต่างๆ นำรูปแบบดังกล่าวไปใช้ แต่กลับกลายเป็นว่า “คนใช้ไม่ได้คิด คนคิดไม่ได้ใช้” เป็นรูปแบบการกระจายอำนาจทางปกครองที่ไม่ตอบสนองต่อคนในท้องถิ่นเอง แต่กลับเป็นการสนองตอบความต้องการของผู้กำหนดนโยบายจากส่วนกลางเพื่อผลทางการเมืองในการออกกฎหมายท้องถิ่น หรืออีกประเด็นปัญหาก็คือ ขาดความจริงใจในการกระจายอำนาจไปยังภาคประชาชนพลเมืองท้องถิ่นอย่างแท้จริง โดยมิได้ทำให้เกิดพลังในการขับเคลื่อนแห่งมวลชน ผู้อยู่อาศัยเป็นกลไกสำคัญในการขับเคลื่อนแต่กลับเป็นการใช้กลไกผ่านทางองค์กรปกครองส่วนท้องถิ่น ผู้นำท้องถิ่น ราชการส่วนภูมิภาค เป็นเงื่อนไขสำคัญในการกระทำหน้าที่แทน โดยมิได้ดึงภาคประชาชนเข้าไปมีบทบาทร่วมแสดงออกซึ่งอำนาจของประชาชนในท้องถิ่น สิทธิในการหวงแหนทรัพยากรท้องถิ่น หรือเป็นส่วนหนึ่งในกระบวนการทางการเมืองท้องถิ่นหลังจากเลือกตั้งผู้นำท้องถิ่นเมื่อได้เสร็จสิ้นไปแล้ว        ผู้เขียนจึงมีความสนใจที่จะสะท้อนบริบททางการศึกษาในอนาคตต่อการปกครองส่วนท้องถิ่นไทยโดยเน้นความดำรงอยู่การเป็นการปกครองท้องถิ่นในลักษณะ “การปกครองท้องถิ่น เพื่อประชาชนคนท้องถิ่นอย่างแท้จริง” โดยเน้นการขับเคลื่อนจากภาคประชาชนท้องถิ่นให้เข้าไปมีบทบาทส่วนร่วมเสมอเคียงคู่ หน่วยงานองค์กรปกครองส่วนท้องถิ่น ดังที่ เอนก เหล่าธรรมทัศน์ (2558) กล่าวว่า” การปกครองส่วนท้องถิ่นในการจะสร้างให้เป็นประชาธิปไตยที่ดีนั้น หัวใจสำคัญคือ ต้องให้มีการปกครองตนเอง” (Self-Government Democracy) จึงจะสามารถนำไปสู่การยกระดับการพัฒนาท้องถิ่นที่ดีเพื่อเป็นประชาธิปไตยในอนาคต         Article aims to study and survey the scope of the Local Government in respect of the powers and the role the local authority and the provision in the Constitution related to past books and articles, textbooks effect.
