ปัญหาทางกฎหมายในการจัดสวัสดิการนักกีฬาสมัครเล่น สังกัดสมาคมกีฬาแห่งประเทศไทย

Abstract

          การศึกษานี้มีวัตถุประสงค์เพื่อศึกษาปัญหาทางกฎหมายเกี่ยวกับการกีฬา องค์กรควบคุมและดูแลการจัดสวัสดิการ หลักเกณฑ์และมาตรการจัดสวัสดิการของนักกีฬาสมัครเล่น สังกัดสมาคมกีฬาแห่งประเทศไทย ขอบเขตในการศึกษาครั้งนี้ ผู้วิจัยได้ทำการศึกษาหลักการ แนวคิด ทฤษฎีและงานวิจัยที่เกี่ยวข้องด้านกฎหมายกีฬา องค์กรกีฬาและสวัสดิการนักกีฬาของไทยและต่างประเทศ ตลอดจนศึกษากฎหมายของนักกีฬาอาชีพเพื่อเปรียบเทียบกับนักกีฬาสมัครเล่น สังกัดสมาคมกีฬาแห่งประเทศไทย         วิธีที่ใช้ในการศึกษา ประกอบด้วยการวิจัยเอกสาร (Documentary Research) โดยศึกษากฎหมายต่าง ๆ ที่เกี่ยวข้องกับการจัดสวัสดิการของนักกีฬาทั้งของประเทศไทยกับประเทศสหพันธรัฐมาเลเซีย ประเทศญี่ปุ่น และประเทศสาธารณรัฐเกาหลี (เกาหลีใต้) รายงานประจำปี หนังสือ วารสาร บทความทางวิชาการ วิทยานิพนธ์ และการสัมภาษณ์เชิงลึก (In-depth interview) เจ้าหน้าที่และนักกีฬาของสมาคมกีฬา จำนวน 6 สมาคมกีฬา ผู้วิจัยได้คัดเลือกกลุ่มตัวอย่างแบบเจาะจง (Purposive sampling) เพื่อเป็นตัวแทนนักกีฬาที่เล่นเป็นทีมและกีฬาที่เล่นเฉพาะบุคคล ทั้งนักกีฬาปกติและนักกีฬาคนพิการ          ผลการศึกษาพบว่า กฎหมายการกีฬาของไทยไม่เอื้ออำนวยและมีข้อจำกัดในการจัดสวัสดิการให้นักกีฬาสมัครเล่น สังกัดสมาคมกีฬาแห่งประเทศไทย ทำให้นักกีฬาขาดขวัญและกำลังใจในการพัฒนาตนเองอย่างต่อเนื่อง สอดคล้องกับข้อมูลที่ได้จากการสัมภาษณ์เจ้าหน้าที่และนักกีฬาว่าแต่ละสมาคมกีฬามีความต้องการที่ตรงกันในเรื่องงบประมาณที่ไม่เพียงพอ ทำให้การบริหารจัดการสวัสดิการไม่ครอบคลุมนักกีฬาทั้งหมด ในทางปฏิบัติสมาคมกีฬาได้นำงบประมาณที่ได้รับจากการกีฬาแห่งประเทศไทยมาจัดเป็นสวัสดิการให้นักกีฬาตามระเบียบที่กำหนดเท่านั้น ซึ่งสวัสดิการขั้นพื้นฐานที่ดีจะเป็นแรงจูงใจให้นักกีฬาได้พัฒนาตนเองให้มีความเป็นเลิศและต่อยอดเป็นนักกีฬาอาชีพ รัฐและการกีฬาแห่งประเทศไทย รวมทั้งสมาคมกีฬาแห่งประเทศไทย จึงควรตระหนักและให้ความสำคัญกับนักกีฬาสมัครเล่น สังกัดสมาคมกีฬาแห่งประเทศไทยโดยการจัดสวัสดิการที่ดี เพราะการส่งเสริมและพัฒนาการกีฬาไปสู่ความเป็นเลิศและเกิดประโยชน์สูงสุดแก่ประชาชนนั้นได้ถูกกำหนดไว้แล้วในรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560          ข้อเสนอแนะ การกีฬาแห่งประเทศไทยซึ่งเป็นหน่วยงานของรัฐมีอำนาจหน้าที่ในการกำกับดูแลและควบคุมสมาคมกีฬา จึงควรมีกฎหมายเพิ่มเติมหรือออกกฎหมายอนุบัญญัติหรือกฎเกณฑ์ แห่งกฎหมาย (By-law) กฎ ระเบียบ เงื่อนไข ให้สมาคมกีฬาแห่งประเทศไทยทุกสมาคมต้องกำหนดหลักเกณฑ์และมาตรการเรื่องสวัสดิการขั้นพื้นฐานแก่นักกีฬาสมัครเล่นไว้ในข้อบังคับของสมาคม เพื่อเป็นหลักประกันความมั่นคงให้แก่นักกีฬาทุกคน ทั้งนี้สวัสดิการที่จัดให้นักกีฬาต้องมีความเหมาะสม จำเป็นและตรงตามความต้องการของนักกีฬาแต่ละชนิดด้วย นอกจากนี้รัฐควรใช้มาตรการทางภาษีและสิทธิประโยชน์อื่นใดให้มากกว่าที่ได้ประกาศกำหนดไว้แล้ว เพื่อเป็นแรงจูงใจให้ภาคเอกชนและภาคประชาชนได้เข้ามาเป็นผู้สนับสนุนหลัก (sponsors) ของสมาคมกีฬาสมัครเล่นแห่งประเทศไทย            This study aims to study legal issues related to Sports, control and supervise welfare organization, and rules and measures for the welfare of amateur athletes affiliated with the Sports Association of Thailand. For the scope of this study, the researcher aims to study principles, theories, concepts and research related to Sports Law, Sports Organization, Athlete’s welfare both in Thailand and Overseas included study the law of professional athletes to compare with Amateur Athletes affiliated with the Sports Association of Thailand.          Furthermore, the researcher has studied the documentary research by studying the laws relating to the Athletes’ welfare in Thailand, Federation of Malaysia, Japan and South Korea included the annual reports, books, journals, Academic articles, theses and in-depth interviews of staff and athletes from six sports associations. The researcher selected purposive sampling to be the Representatives of Team-based athletes and personalized sports; both regular athletes and disabled athletes.          The study indicated that Sports laws of Thailand are unfavorable and limited to provide the welfare of amateur athletes affiliated with the Sports Association of Thailand caused the lack of morale and self-development continuously consistent with the information obtained from interviews with the officials and the athletes that each sports association has insufficient budgets and the welfare administration does not cover all athletes. In practice, the Sports Association has adopted a budget from the Sports Authority of Thailand to provide the welfare of athletes according to the prescribed rules because a good basic welfare will motivate the athletes to develop themselves become professional athletes. It is necessary that the State and Sports Authority of Thailand, as well as, the Sports Association of Thailand should focus on amateur athletes affiliated with the Sports Association of Thailand by providing a good welfare because the Sports promotion and development is effective and acceptable according to the Constitution of the Kingdom of Thailand B.E. 2560.          As the above mentioned, The Sports Authority of Thailand which is the state agencies and has power to regulate the Sports Association of Thailand to enact additional legislation or by-law regulations for all the Sports Association of Thailand and specify rules and measures of basic welfare for amateur athletes in the Association's regulations which guarantee the stability of all athletes to provide the appropriate and necessary welfares according to the needs of each type of athletes. In addition, the state should enforce the tax measures and other benefits more than the past to motivate the private sector and the public to become the main sponsors of the Amateur Athletes affiliated with the Sports Association of Thailand.
