กฎหมายว่าด้วยการใช้อำนาจหน้าที่ของสภาอุดมศึกษาของรัฐตามหลักนิติธรรมและหลักธรรมาภิบาล

Abstract

          การวิจัยนี้มีวัตถุประสงค์ในการจัดทำกฎหมายต้นแบบว่าด้วยการใช้อำนาจหน้าที่ของสภาสถาบัน อุดมศึกษาของรัฐตามหลักนิติธรรมและหลักธรรมาภิบาล โดยมีวิธีวิทยาการวิจัยเป็นวิจัยเชิงคุณภาพประกอบด้วย การวิจัยเอกสาร การสัมภาษณ์เชิงลึก การมีส่วนร่วมออกแบบ และการรับฟังความคิดเห็น          ข้อค้นพบของการวิจัยคือการใช้อำนาจหน้าที่ของสภาสถาบันอุดมศึกษาจะต้องมีหลักนิติธรรมและธรรมาภิบาล โดยมีกฎหมายต้นแบบเพื่อการปรับปรุงแก้ไขพระราชบัญญัติการอุดมศึกษา พ.ศ. 2562 ที่มีโครงสร้างกฎหมายประกอบด้วยการได้มาซึ่งกรรมการสภาสถาบันอุดมศึกษา อำนาจและหน้าที่ หลักนิติธรรมและธรรมาภิบาล การตรวจสอบการใช้อำนาจและหน้าที่ของสภาสถาบันอุดมศึกษา และความรับผิดของสภาสถาบันอุดมศึกษา          ข้อเสนอแนะของการวิจัย คือ การนำกฎหมายต้นแบบของการวิจัยเพื่อการปรับปรุงแก้ไขเป็นแนวทางในการปรับปรุงแก้ไขพระราชบัญญัติการอุดมศึกษา พ .ศ. 2562 เพื่อให้สภาสถาบันอุดมศึกษาใช้อำนาจหน้าที่ในการควบคุมการบริหารจัดการสถาบันอุดมศึกษาให้มีมาตรฐานการศึกษา ข้อเสนอแนะเรื่องที่วิจัยต่อ คือ กฎหมายว่าด้วยการใช้อำนาจหน้าที่ของฝ่ายบริหารสถาบันอุดมศึกษาตามหลักนิติธรรมและหลักธรรมาภิบาล           The objective of this research is to create a model law on the execution of the authority of the Higher Education Council according to the rule of law and good governance. Research methodology is Qualitative research consisting of Documentary research; In-depth interview; Participatory Design, Co- Design; and Hearing.          The research found out that the execution of the authority of the Higher Education Council must have the rule of law and good governance. The model law for the amendment of the Higher Education Act, BE 2562 with a legal structure consisting of the acquisition of the Higher Education Council; authority; principle of the rule of law and good governance; examination of the execution of the authority and liability of the Higher Education Council.          The recommendation of the research is to apply the model law of the research for the improvement to be a guideline for the amendment of the Higher Education Act, BE 2562 in order to execute the authority to control the management of the Higher Education Administration for better education standard. Further research recommended to be “A Model law for the execution of Higher Education Administration according to the rule of law and good governance”.
