รูปแบบองค์กรเพื่อการป้องกันและปราบปรามการค้ามนุษย์

Abstract

           การวิจัยนี้มีวัตถุประสงค์ในการจัดทำรูปแบบองค์กรเพื่อการป้องกันและปราบปรามการค้ามนุษย์ที่มีอำนาจหน้าที่ชัดเจนเพียงองค์กรเดียวในการสืบสวนจับกุม การสืบสวนจับกุมสอบสวนดำเนินคดี และคุ้มครองเยียวยา มีพื้นที่รับผิดชอบทั่วราชอาณาจักร วิธีวิทยาการวิจัยที่ใช้เป็นการวิจัยเชิงคุณภาพประกอบด้วยการวิจัยเอกสาร การสัมภาษณ์เชิงลึก การมีส่วนร่วมออกแบบ, ร่วมออกแบบ และการรับฟังความคิดเห็น            ผลการวิจัยพบว่า ปัญหาการป้องกันและปราบปรามการค้ามนุษย์ไม่มีประสิทธิภาพเพราะการมีหลายองค์กรที่ทำหน้าที่ในการป้องกันและปราบปรามการค้ามนุษย์ทำให้เกิดความทับซ้อนกัน ขาดการบูรณาการการทำงานร่วมและประสานกัน ขาดการตรวจสอบถ่วงดุลระหว่างองค์กร จนเป็นช่องว่างกฎหมายให้เจ้าหน้าที่แสวงหาประโยชน์จากการใช้อำนาจหน้าที่โดยมิชอบ การวิจัยจึงเสนอให้จัดตั้งองค์กรในรูปแบบขององค์คณะสืบสวนสอบสวนคดีค้ามนุษย์ ประกอบด้วย 6 องค์กร คือ สำนักงานตำรวจแห่งชาติ กองบังคับการปราบปรามการค้ามนุษย์ กรมสอบสวนคดีพิเศษ กรมการปกครอง สำนักงานอัยการสูงสุด กระทรวงการพัฒนาสังคมและความมั่นคงของมนุษย์ มีขอบเขตอาจหน้าที่รับผิดชอบคดีค้ามนุษย์ ทั่วราชอาณาจักร           ข้อเสนอแนะของการวิจัย คือ ให้มีการจัดตั้งองค์คณะสืบสวนสอบสวนคดีค้ามนุษย์โดยมีการจัดทำกฎหมายรองรับเพื่อให้การป้องกันและปราบปรามการค้ามนุษย์มีประสิทธิภาพมากขึ้น ข้อเสนอแนะหัวข้อวิจัยต่อคือการจัดทำประมวลกฎหมายว่าด้วยการค้ามนุษย์           The objective of this research is to establish an organization model for the prevention and suppression of human trafficking which has authority in investigation for arrest; investigation and arrest for prosecution; and remedy. The responsibility area cover throughout the Kingdom. Research methodology is qualitative research including documentary research; in-depth interview; participatory design, co-design; and hearing.           The research found out that the problem of ineffectiveness of prevention and suppression of human trafficking due to many organizations have the same authority in investigation for arrest; investigation and arrest for prosecution; and remedy which overlapping, lack of integration, checks and balances among responsible organizations which cause legal gap for government officials to improperly exploit. The research therefore proposed to establish a committee organization consisting of 6 organizations which are Royal Thai Police; Human Trafficking Suppression Division; Department of Special Investigation; Department of Provincial Administration; Office of the Attorney General; Ministry of Social Development and Human Security. The jurisdiction authority throughout the Kingdom.          The research suggested to establish a committee organization with legal support for the effectiveness of prevention and suppression of human trafficking. Further research recommended to be “The draft of code on Human Trafficking.
